BEABLE HEALTH PRIVATE LIMITED (“We”) are committed to protecting and respecting your privacy. You acknowledge that this privacy policy (“Policy”) is part of the Services and you unconditionally agree that becoming an End-User of the Services provided via the Device and the Services Site (hereinafter defined), signifies your assent to this Policy. Unless otherwise defined herein, capitalized terms used in this Policy have the meanings attributed to it in the EULA. 

1.  SCOPE OF POLICY 

1.1  This privacy policy (“Policy”) together with our EULA, applies to Your use of:

(i) The Services, once You have downloaded a copy of the Software onto your ArmAble or Phone or Tablet (“Device”); and 

(ii)  Any of the Services that are available on www.beablehealth.com (Services Site). 

1.2  This Policy sets out the basis on which any personal data we collect from You, or that you provide to us, will be processed by us. 

1.3   Please read the following carefully to understand our views and practices regarding your personal data and how We will treat it. 

2.  INFORMATION WE MAY COLLECT FROM YOU 

2.1   We may collect and process the following data submitted by you:

(i)  You may give us information about you by filling in forms on the Services Site, Application, or by corresponding with us (for example, by e-mail or chat); 

(ii) This includes information you provide when you register to use the Services, download the Software or register the Device, subscribe to any of our Services, share your data with us by any other means, enter a promotion or survey, and when you report a problem with the Device, our Services, or any of our Services Site; and 

 (iii)  The information you give us may (but not limited to) include your: 

(a) Name,

(b) Speciality / condition 

(c) E-mail address, 

(d) Age group,

(e) Qualification, 

(f) Password and other registration information, 

(g) Photograph 

(h) Gender 

(iv) If you contact us, we may keep a record of that correspondence. 

2.2  Information we collect about you and your Device: Each time you visit the Services Site or us on the Device, we may automatically collect the following information: 

 (i) Information stored on your Device, login information, device information, access to file storage. photos, videos or other digital content relevant to the application. (Content Information); 

(ii) Details of your use of our Device or your visits to any of the Services Site [including, but not limited to, traffic data, location data, weblogs and other communication data, whether this is required for our own billing purposes or otherwise] and the resources that you access (Log Information). 

2.3 Location information. We may also use IP Information to determine your current location. Some of our location-enabled Services require your personal data for the feature to work. If you wish to use the particular feature, you will be asked to consent to your data being used for this purpose. You can withdraw your consent at any time by writing to us at developer@beablehealth.com 

3.  USES MADE OF THE INFORMATION 

3.1 We use information held about you for a range of different purposes in the following ways:

 (i)  Submitted Information: For creating a unique user profile. 

(ii)  Device information: For licensing. 

(iii)   Log information: For meta data analysis. 

(iv) Location information: For meta data analaysis. 

3.2 We may use your data for other purposes, provided we disclose the purposes and use to you at the relevant time, and provided that you consent to the proposed use of your personal data. 

4.2 We may disclose your personal information to any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined under the Companies Act, 2013. 

4.3 We may disclose your personal information to third parties: 

(i)  In the event that We sell or buy any business or assets, in which case we may disclose your personal data to the prospective seller or buyer of such business or assets. 

(ii) If BEABLE HEALTH PVT LTD or substantially all of its assets are acquired by a third party, in which case personal data held by it about its customers will be one of the transferred assets. 

(iii)  If we are under a duty to disclose or share your personal data in order to comply with any legal or regulatory obligation or request. 

(iv)In order to: 

(a) Enforce or apply the EULA or to investigate potential breaches; or 

(b) Protect the rights, property or safety of BEABLE HEALTH PVT LTD our customers, or others. This includes exchanging information with other companies and organisations for the purposes of fraud protection and credit risk reduction. 

4.4 We will disclose your information if you have agreed that we may do so in accordance with this Policy. We will make this clear to you at the point at which we collect your information, including the purpose(s) for which we will use the data. 

(i)  Data Access and Portability 

You may be entitled to request copies of your personal information held by us. 

(ii) Change or Correct Data

You have the right to ask us to correct change, update or rectify your data. 

(iii) Data Retention and Deletion 

We generally retain data for as long as needed to provide the Services. However, specific retention times can vary based on context of the processing we perform and on our legal obligations. You have the right to ask us to delete all or some of the personal data we hold about you. We may need to retain some of your personal data even after you have closed your account if reasonably necessary to comply with our legal obligations, or where we have a legitimate interest in doing so (e.g. to prevent fraud and abuse and maintain and enhance security). 

(iv) Objection to Processing 

You may object to processing your personal information in some circumstances (in particular, where we don’t have to process the information to meet a contractual or other legal requirement, or where we are using the information for direct marketing). If you object to such processing We will no longer process your personal information for these purposes unless we can demonstrate compelling legitimate grounds for such processing or such processing is required for the establishment, exercise or defense of legal claims or obligations. 

(v)Restriction of Processing

Under certain circumstances, you may have the right to limit the ways in which we use your personal information. 

(vi) Withdrawing Consent 

Where you provide consent to the processing of your personal information by us, you may withdraw your consent at any time by sending a communication to us specifying the specific consent you are withdrawing.
